Pour faire très court altern.org a été contrait de fermer, et avec lui c'est plus de 2 000 000 pages sur 47 000 sites de tous genres qui s'éteignent.
 

Tout ça a cause de quelques photos d'Estelle Hallyday qui ont été postées sur un site hébergé par altern et dont elle a eu connaissance.  Pour faire court du fait qu'Estelle ne veuille pas, par intérêt ou par flemme, remonter jusqu'à l'auteur du site elle s'arrête au niveau de l'hébergeur, altern.org en la personne de Valentin Lacambre.

Je suis de l'autre côté de la barrière, je sais, en tant qu'auteur ne suis-je pas en prémière ligne ?

Oui, à condition que le plaingnant veuille bien porter plainte contre moi. Mais ici E.H. s'est arrêtée à l'hébergeur, faisant porter en France, en l'absence de législation claire à ce sujet, tous les hébergeurs responsables de tout le contenu de tous les sites qu'ils hébergent. 

Alors, quelle est mon problème ?

Le principe!  Si je n'avais pas commencé pa un hébergement gratuit pour mon premier site, je n'en serais pas là aujourd'hui.  Pensez-vous que quelqu'un dont le site vient d'être supprimé chez altern.org ira chez un autre hébergeur du même type demain si le risque existe que dans une semaine tout sera à refaire à cause de quelque chose hors de son contrôle et franchement hors du contrôle de l'hébergeur ?  Je pense que non.  Si on récupère du panier la moitié des sites qui ont été supprimés je serais étonné - et ça voudrait dire plus de 20 000 sites francophones en moins. 

Tout ça parce que Estelle Hallyday, qui, est ce n'est pas un secret gagne sa vie à vendre les photos de son corps à choisi de poursuivre ce type.  Et quid de tous les autres sites de "célebrités nues" ?  Il en existe des dizaines (des centaines) où vouz pouvez voir les mêmes photos!  Ce n'étais pas le seul site où vous pouviez obtenir du matériel "non-autorisé" sur E.H. & Cie.  Il y en avait même qui faisaient payer pour ce genre de truc.

On dirait que altern.org ait été choisi pour ce procès car Valentin n'a pas les moyens (financiers) de se défendre.  C'est sûr qu'il y a des gros sous dans la balance si on élimine les hébergeurs gratuits en leur faisant porter le chapeau à la place des auteurs de sites..
 

Le précedent (légal) n'est pas loin; Valentin a perdu en appel et la seule cour supérieur est le Conseil d'Etat.  Aux vues de comment l'affaire a été traité jusqu'à là, on peut se préparer au pire...

All that for a few photos of Estelle Halliday that were posted on a subdomain hosted by altern and which came to her attention.  In short, because Estelle does not wish to, or had been advised not to, go after the site's author, she stopped at the sites host in the person of Valentin Lacambre.
 

I'm on the other side of the fence, I know.  As the autor am I not responsible ?
 

Yes, if the plantif comes after me.  But in this case E.H. stoppped at the site's hosting service meaning that in France, in the absence of clear legislation on this subject, all web hosts are responsible for the entire content of all the sites they host.

So what's the problem for me ?

The principle ! Had I not started my first site on a free host  I probably would never have started.  Do you think that the guy whose site has just been erased at altern.org will go to another free host tomorrow if the risk still exists that he may have to start again from scratch next week because of something that it completely out of his control, and quite frankly out of the control of the host ?  I don't think so.  If even half of the sites that have just been erased are back on the web eventually I'll be surprised - and that will mean 20 000 fewer french-language websites.
 

All that because Estelle Hallyday, who let's face it makes a living out of selling photos of her body, chose to go after this guy - but what about all the other celebrity nude sites ?  There are still tens (hundreds) of sites where you can probably see the same photos!  This was not the only site where you could get hold of "unauthorised" material on E.H. & Co.  Some other sites even charge you money for the stuff!
 

It all looks like altern.org was chosen for this special treatment because Valentin isn't (financially) capable of going the distance.  There's certainly big money to be made if the free web hosts get squeezed out of the game, through fear of prosecution in lieu website authors.

The (legal) precendent is not far from being set;  Valentin lost his appeal and the only court left now is the Conseil d'Etat.  Looking at how the affair has been handled by the judiciary up to now: brace yourself for the bad news...
